本契約は、お客様と当社との間で、本アプリの使用に関して定めるものです。本アプリをダウンロード・インストールまたは使用した時点で、お客様は本契約に同意したものとみなされます。同意いただけない場合、本アプリを使用しないでください。
なお、Apple の標準使用許諾契約（Licensed Application End User License Agreement）の各条項も適用され、本契約はこれを補足するものです。両者が矛盾する場合、本アプリ固有の事項については本契約が優先します。
当社は、お客様に対し、App Store の利用規約（Usage Rules）に従い、お客様が所有または管理する Apple ブランド製品上で本アプリを使用する、譲渡不能・非独占的なライセンスを付与します。
お客様は、次の行為を行ってはなりません。 - 本アプリの複製、改変、リバースエンジニアリング、逆コンパイル、逆アセンブル（適用法令が許容する範囲を除く） - 本アプリの再配布、貸与、リース、サブライセンス、販売 - 本アプリまたは連携サービスの正常な運用を妨げる行為、不正アクセス
本アプリが表示する運航情報（出発・到着時刻、遅延、欠航、ゲート、ターミナル等）は、航空会社および第三者データ提供事業者（FlightAware 等）から取得したものであり、正確性・完全性・即時性を保証するものではありません。
本アプリは「現状有姿（AS IS）」で提供され、明示黙示を問わず、商品性、特定目的適合性、非侵害を含むいかなる保証も行いません。
適用法令が許容する最大限の範囲において、当社は、本アプリの使用または使用不能から生じる間接損害、付随的損害、特別損害、結果的損害について責任を負いません。
本アプリは第三者のサービスおよびデータ（FlightAware、Apple の iCloud/CloudKit 等）を利用します。これら第三者の提供内容・可用性・利用条件について当社は責任を負わず、お客様は各第三者の規約にも従うものとします。
本アプリの一部機能は買い切り課金（Estela Lifetime）で提供されます。 - 課金・請求は Apple（App Store）を通じて処理されます。 - 解約・管理は、お客様の Apple ID の設定から行えます。 - 価格・提供内容は変更される場合があります。
本アプリの個人データの取扱いについては、別途定めるプライバシーポリシー（https://www.techtune.works/apps/estela/privacy ）をご確認ください。パスポート情報等の機微なデータの扱いを含みます。
お客様は以下を確認し、同意します。 - 本契約は、お客様と当社との間で締結されるものであり、Apple との間で締結されるものではありません。本アプリおよびその内容について責任を負うのは当社であり、Apple ではありません。 - Apple は、本アプリに関する保守・サポート義務を一切負いません。 - 本アプリが適用される保証に適合しない場合、お客様は Apple に通知でき、Apple は（該当する場合）購入代金を返金する場合があります。適用法令が許容する範囲において、Apple はそれ以外の一切の保証義務を負いません。 - 製品責任、法令不適合、消費者保護法令上の請求、第三者の知的財産権侵害の主張への対応は、当社が責任を負います。 - Apple およびその子会社は本契約の第三受益者であり、お客様が本契約に同意した時点で、Apple は本契約をお客様に対して行使する権利を有します。 - お客様は、米国政府の禁輸対象国に所在せず、また米国政府の制限・禁止当事者リストに掲載されていないことを表明します。
お客様が本契約に違反した場合、本契約に基づくライセンスは自動的に終了します。終了後、お客様は本アプリの使用を停止する必要があります。
本契約は日本法に準拠し、これに従って解釈されます。本アプリに関して紛争が生じた場合、東京地方裁判所を第一審の専属的合意管轄裁判所とします。
本契約は日本語を正文とします。他言語版が提供される場合であっても、日本語版と相違があるときは日本語版が優先します。

This Agreement governs your use of the App between you and the Company. By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.
Apple's standard Licensed Application End User License Agreement also applies, and this Agreement supplements it. In case of conflict on matters specific to the App, this Agreement controls.
Subject to the App Store Usage Rules, the Company grants you a non-transferable, non-exclusive license to use the App on any Apple-branded products that you own or control.
You may not: - copy, modify, reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law; - redistribute, rent, lease, sublicense, or sell the App; - interfere with the normal operation of the App or its connected services, or gain unauthorized access.
Flight information shown in the App (departure/arrival times, delays, cancellations, gates, terminals, etc.) is obtained from airlines and third-party data providers (such as FlightAware) and is not guaranteed to be accurate, complete, or up to date.
The App is provided "AS IS" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use the App.
The App uses third-party services and data (FlightAware, Apple iCloud/CloudKit, etc.). The Company is not responsible for the content, availability, or terms of these third parties, and you agree to comply with their respective terms.
Some features are offered via a one-time purchase (Estela Lifetime). - Billing and payment are processed through Apple (the App Store). - You can manage this in your Apple ID settings. - Prices and offerings are subject to change.
Your personal data is handled in accordance with our Privacy Policy (https://www.techtune.works/apps/estela/privacy), including how sensitive data such as passport information is treated.
You acknowledge and agree that: - This Agreement is between you and the Company only, not with Apple. The Company, not Apple, is solely responsible for the App and its content. - Apple has no obligation to furnish any maintenance or support services for the App. - In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. - The Company is responsible for addressing any claims relating to the App, including product liability, legal or regulatory non-compliance, consumer protection claims, and third-party intellectual property infringement claims. - Apple and its subsidiaries are third-party beneficiaries of this Agreement and, upon your acceptance, have the right to enforce this Agreement against you. - You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government restricted-party list.
The license under this Agreement terminates automatically if you breach it. Upon termination, you must stop using the App.
This Agreement is governed by and construed under the laws of Japan. Any dispute relating to the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
The Japanese version of this Agreement is the authoritative text. If versions in other languages are provided, the Japanese version shall prevail in the event of any discrepancy.
